These terms cover your use of ashleymcpherson.com and the free strategy call you can book here. Paid work is covered by its own written agreement. By using the site, you agree to these terms.

Who we are

ashleymcpherson.com is run by Ashley McPherson, based in Charleston, South Carolina. “We,” “us” and “our” mean Ashley McPherson and the team that supports her work. Questions go to hi@ashleymcpherson.com.

Using the site

You must be at least 18 to use the site or book a call. Please use it fairly: no hacking, scraping, spamming, uploading harmful code, pretending to be someone else, or interfering with how the site works.

Booking a strategy call

The free 20-minute strategy call is a conversation about your business and where AI could help. There’s no cost and no obligation. You book through our scheduling page, run by LeadConnector, and you agree to give accurate details. You can reschedule or cancel with the link in your confirmation or by emailing us, and we may reschedule or decline a booking when we need to. A call on its own doesn’t create a client relationship or a contract for services.

Paid services

If you hire us, a separate written proposal or agreement sets out the scope, fees, timing and the company providing the work. That agreement controls if it conflicts with these terms.

Text messages

If you agree to receive texts about your call, here’s how the program works:

  • Program: appointment confirmations, reminders and scheduling updates for calls with Ashley McPherson.
  • Frequency: message frequency varies with your booking.
  • Costs: message and data rates may apply.
  • Opting out: reply STOP at any time. You’ll get one text confirming you’ve opted out.
  • Help: reply HELP, or email hi@ashleymcpherson.com.
  • Consent to texts isn’t a condition of booking a call or buying anything.
  • Mobile carriers aren’t liable for delayed or undelivered messages.

AI and your decisions

Our content and services often involve AI tools, and AI can produce wrong, incomplete, biased or outdated output. Any AI-generated content, example, template or output on the site or from a free call is provided as is, without any warranty of accuracy, completeness, reliability or fitness for a particular purpose, and you shouldn’t rely on it without your own independent review.

Our method keeps a human in charge of every AI: you review the output, make the final decisions and are solely responsible for them. Every AI reports to a human.

General information only

Everything on the site is general information about running a business with AI. Nothing on the site counts as legal, financial, tax, investment or accounting advice, so please talk to a qualified professional about your own situation.

Results

Outcomes depend on your business, your data and your follow-through. Nothing on this site promises a specific result. Examples, press coverage and descriptions of past work show what’s possible and aren’t a guarantee.

Content and trademarks

The site’s text, images, design and methods, including the AI ROI Method™ and Margin Multiplier, belong to Ashley McPherson or are used with permission. You may view and share pages for personal, non-commercial use. Please don’t copy, republish or sell site content, or use it to train AI models, without written permission.

Press and brand names and logos belong to their owners, and showing them doesn’t mean those companies endorse us. Photos of Ashley with other people show events and meetings and don’t imply endorsement.

Disclaimers

The site is provided as is and as available. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don’t promise the site will always be available or free of errors.

Limits on liability

To the extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site or a free call. Our total liability for any claim about the site or a free call is limited to $100. Liability for paid work is set by your service agreement.

Indemnification

You agree to defend, indemnify and hold harmless Ashley McPherson and the team members, contractors and agents who support her work from any claims, demands, losses, liabilities, damages, judgments, settlements, costs and expenses, including reasonable attorneys’ fees, that arise from:

We may take control of the defense of any claim at your expense, and you agree to cooperate with us. You won’t settle a claim that affects us without our written consent.

Disputes and arbitration

Governing law. South Carolina law governs these terms, without regard to its conflict-of-law rules. The Federal Arbitration Act governs this section.

Talk to us first. Before starting arbitration, email hi@ashleymcpherson.com with a description of the dispute and give us 30 days to resolve it informally.

Binding arbitration. If we can’t resolve it, any dispute, claim or controversy arising out of or relating to these terms, the site or a free call will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its rules in effect at the time, including its Consumer Arbitration Rules where they apply. A single arbitrator will decide the dispute. The arbitration will take place in Charleston, South Carolina, or by video or phone if the arbitrator agrees, and any court with jurisdiction may enter judgment on the award. Disputes about paid work follow your service agreement.

Exceptions. Either side may bring an individual claim in small claims court, and either side may ask a court for an injunction to protect intellectual property or stop misuse of the site.

No class actions or jury trials. Disputes will be resolved only on an individual basis. You and we each waive the right to a jury trial and to take part in a class, collective or representative action.

Opting out. You can opt out of this arbitration agreement within 30 days of first using the site by emailing hi@ashleymcpherson.com with your name and the words “Arbitration opt-out.” If you opt out, or if this section is found unenforceable, disputes will go to the state courts in Charleston or Berkeley County, South Carolina, or the U.S. District Court for the District of South Carolina, Charleston Division, and you agree to their jurisdiction.

Changes to these terms

We may update these terms, and the date at the top will show the latest version. If you keep using the site after a change, the updated terms apply.
